Agreement to Terms

By accessing or using The Feedback Agent (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all users of the Service, including those who submit feedback ("Senders") and those who receive feedback ("Recipients").

Service Description

The Feedback Agent enables users to:

  • Send anonymous constructive feedback to others via email
  • Receive anonymous feedback through secure, token-based links
  • Optionally have AI improve the tone and clarity of feedback
  • Track the status of sent feedback
  • Respond to feedback received

The Service uses AI to check content safety and optionally improve communication quality while maintaining anonymity.

Eligibility

You must be at least 13 years old to use this Service. By using the Service, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will use the Service in compliance with these Terms and all applicable laws

Acceptable Use Policy

You MAY use the Service to:

  • Provide constructive, actionable feedback to others
  • Share honest perspectives in a respectful manner
  • Request and receive feedback on your performance or behavior
  • Facilitate improvement and professional growth

You MAY NOT use the Service to:

  • Harass, threaten, or abuse others - No personal attacks, intimidation, or hostile communication
  • Discriminate or promote hate - No content targeting race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Share illegal content - No content that violates laws or regulations
  • Violate privacy - No sharing of private information without consent (doxxing)
  • Spam or abuse the system - No automated submissions, excessive messages, or attempts to bypass rate limits
  • Impersonate others - No fraudulent representation of identity or affiliation
  • Attempt to break security - No hacking, token guessing, or other security attacks
  • Use for commercial solicitation - No advertising, marketing, or promotional content

Enforcement: We use AI to automatically check all content for safety violations. Content that violates these policies may be blocked before delivery, and repeated violations may result in rate limiting or access restrictions.

Content Safety & AI Processing

Automated Safety Checks

All feedback and responses are processed through AI systems (Anthropic Claude or OpenAI GPT) to:

  • Detect harassment, hate speech, threats, and other harmful content
  • Assess constructiveness and tone
  • Optionally improve clarity and professionalism (with your approval)

Important: Content flagged as high-severity will be blocked and not delivered. You will be notified if your content is blocked.

Medium-severity issues will trigger warnings but may still be sent if you choose to proceed.

User Control

You always review and approve AI changes before content is sent. You can choose to use the original version, the improved version, or edit further. We never send AI-modified content without your explicit approval.

Reporting Abuse

How to Report

If you receive feedback or a response that violates these Terms or contains harmful content, you can report it directly through the Service. Each feedback and response page includes a "Report Abuse" option.

Reports can be submitted anonymously or with your contact information if you wish to receive follow-up.

Report Categories

You can report content for:

  • Harassment or bullying: Personal attacks, intimidation, or hostile communication
  • Hate speech or discrimination: Content targeting protected characteristics
  • Threats or violence: Content threatening harm or violence
  • Spam or abuse: Unsolicited messages or system abuse
  • Privacy violation: Sharing private information without consent
  • Illegal content: Content that violates laws or regulations
  • Other: Any other violation of these Terms

What Happens to Reports

  • Immediate Protection: When you report feedback, the sender is immediately blocked from sending you future messages
  • Email Confirmation: You will receive an email confirming your report and active block status
  • Staff Review: All reports are reviewed by our team within 24-48 hours
  • Additional Action: Staff may escalate blocks, remove blocks if reports are unfounded, or take other appropriate action
  • Law Enforcement: We will contact authorities for illegal activity or credible threats

Block List System

When you report abusive feedback, a block is automatically activated. There are three types of blocks:

  • Sender-Specific Block (Default): The specific sender who sent the abusive feedback is blocked from sending you future messages. Other people can still send you feedback.
  • Full Block (Staff-Activated): In cases of severe or repeated abuse, staff may activate a full block, preventing anyone from sending you feedback temporarily.
  • Temporary Block: Blocks may be set to expire after a specified period (e.g., 30 days) to give a cooling-off period.

You will see your active block status when viewing feedback, and you can contact support at any time to discuss blocks.

Appeal Process

If you believe you have been blocked unfairly, you may appeal by contacting support at [email protected] with your report ID or details. Appeals will be manually reviewed by staff.

Note: Due to the anonymous nature of the Service, blocked senders are not notified of the block. This protects recipient privacy and prevents retaliation.

False Reports

Submitting false or malicious reports is a violation of these Terms. Abuse of the reporting system may result in rate limiting, restrictions, or termination of access to the Service.

Report Privacy

Reports are kept confidential. We do not share reporter identity with the person being reported unless legally required. However, anonymity cannot be guaranteed in cases involving law enforcement or legal proceedings.

Anonymity & Privacy

What "Anonymous" Means

When you send feedback:

  • Recipients do NOT see your email address - Your identity is not revealed to the person receiving feedback
  • Optional sender email - You can provide an email for tracking and receiving responses, but this is never shared with recipients
  • Secure tokens - Access is controlled via cryptographically random tokens, not identifiable information

Anonymity Limitations:

  • • We cannot prevent recipients from guessing who sent feedback based on content, timing, or context
  • • If you include identifying information in the feedback itself, you compromise your own anonymity
  • • Anonymity does not protect illegal activity - we will cooperate with law enforcement when legally required

Intellectual Property & Content

Your Content

You retain ownership of all feedback and responses you submit. By using the Service, you grant us a limited license to:

  • Store and process your content to provide the Service
  • Process content through AI systems for safety and improvement
  • Deliver your content to intended recipients

We will not use your content for purposes beyond providing the Service without your explicit consent.

AI-Generated Content

When you approve AI-improved versions of your content, you acknowledge that the improved version is a derivative work created collaboratively between you and our AI systems. You are free to use this content as you wish.

Disclaimers & Limitations

Service Provided "AS IS"

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

No Guarantee of Availability

We do not guarantee that the Service will be available at all times or that it will be error-free. We may suspend or terminate the Service at any time for maintenance, updates, or other reasons.

AI Accuracy

While our AI systems are designed to improve feedback quality and detect harmful content, they are not perfect. We do not guarantee that AI assessments are accurate or that all harmful content will be caught. Users are responsible for their own content.

Not Professional Advice

The Service is for peer feedback only. It does not provide professional counseling, legal advice, medical advice, or other professional services. For professional matters, consult a qualified expert.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code that may be transmitted through the Service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service
  • User content or the defamatory, offensive, or illegal conduct of any third party

Indemnification

You agree to indemnify, defend, and hold harmless The Feedback Agent, its operators, and affiliates from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including:

  • Violation of these Terms
  • Abuse of the Service or other users
  • Illegal activity
  • Requests from law enforcement

Upon termination, your right to use the Service will immediately cease. You may also stop using the Service at any time.

Dispute Resolution

If you have a dispute with us, please contact us first and we will attempt to resolve it informally. If we cannot resolve the dispute informally, any disputes will be resolved through binding arbitration in accordance with the laws of Idaho.

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Idaho, without regard to its conflict of law provisions.

Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify users by:

  • Updating the "Last Updated" date at the top of this page
  • Providing notice through the Service or via email

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
